Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Kakariki Technology Limited (“Kakariki”, “we”, “us”), a company registered in New Zealand, governing your use of Librevet Ortho and related services we provide through librevet.com and its subdomains (the “Service”).
By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and a qualified veterinary professional — veterinarian, veterinary surgeon, registered veterinary technician, veterinary student under supervision, or a person working in a comparable role — to use the Service. By creating an account you represent that this is true.
We may refuse, suspend, or terminate access if we reasonably believe you do not meet these criteria.
2. Your account
You are responsible for keeping your credentials secure. You must promptly notify us if you suspect unauthorised access to your account. You are responsible for all activity that occurs under your account. We may suspend accounts that show signs of abuse, automated activity, or attempted exploitation of the Service.
3. The Service is provided free of charge
We provide the Service to qualified users at no cost. We reserve the right to introduce paid tiers, usage limits, or to discontinue free access at any time, with reasonable notice. We will not charge you for any feature without your prior explicit agreement.
4. Licence to use the Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your professional veterinary practice. You may not:
- Resell, sublicence, or otherwise commercially exploit the Service or any part of it;
- Reverse engineer, decompile, or attempt to extract the source code of the Service except to the extent expressly permitted by mandatory law;
- Use the Service to develop a competing product;
- Use automated means (scrapers, bots, scripts) to access the Service except via documented APIs and within published rate limits;
- Circumvent any security, authentication, abuse-prevention, or rate-limiting mechanism;
- Upload content that infringes anyone’s rights, contains malware, or violates applicable law.
5. Clinical disclaimer — please read carefully
Librevet Ortho is a planning and visualisation aid. It is not a medical device, a diagnostic device, or a clinical decision-making system. The Service does not provide veterinary advice, diagnosis, treatment, or prognosis. All measurements, suggestions, overlays, and annotations produced by the Service are informational and must be independently verified by the qualified veterinary professional responsible for the case before being applied to any patient.
You are solely responsible for any clinical decision you make. We accept no responsibility for clinical outcomes, surgical complications, equipment compatibility, or any other consequence arising from your use of the Service to inform a clinical decision. If you are not confident in a measurement or a planned procedure, do not rely on the Service.
You must comply with all veterinary professional standards and regulations applicable to you in your jurisdiction.
6. Your content
You retain all rights in the radiographic images, case notes, measurements, and other content you upload to the Service (“Your Content”).
For the purpose of providing the Service to you, you grant Kakariki a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and process Your Content as required to operate the Service for your benefit (for example, to render the images in your browser, generate measurements, and provide sharing functionality you initiate).
This licence is limited to operating the Service. It does not give us the right to use Your Content for ML training, marketing, sale, or any other secondary purpose. The only exception is the optional ML Programme described in section 7.
7. ML Programme contribution (opt-out)
Because Librevet Ortho is provided to you free of charge, you grant Kakariki a perpetual, worldwide, royalty-free, non-exclusive licence to use de-identified imaging data and structured clinical metadata from Your Content for the purpose of training, evaluating, and improving Kakariki’s machine learning and AI models, and to incorporate the learnings into Kakariki products. This is described in detail in the Privacy Policy, section 4.
Before any data is used under this licence, identifying information (case identifiers, patient names, owner names, clinic identifiers, free-text notes) is removed by automated de-identification.
You may opt out of this contribution at any time by disabling the “Contribute imaging data to AI development” toggle in your account Settings. Opting out stops future use of your data for ML Programme purposes; it does not require us to retrain or remove your contributions from models already trained at the time you opt out. You may request specific previously-uploaded cases be excluded from future training cycles by contacting us.
This licence is non-sublicensable except to our service providers operating under written confidentiality and data-processing terms.
8. Sharing features
The Service may include features that allow you to share cases or invite collaborators. You are responsible for ensuring you have the necessary rights and any required consents from the owners of the relevant patients to share that material. We are not responsible for how recipients use shared material.
9. Our intellectual property
The Service, including all software, user interfaces, designs, trademarks, logos, and documentation, is owned by Kakariki or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you ownership of any part of the Service.
The names Librevet and Librevet Ortho, and the associated logo, are trademarks of Kakariki Technology Limited. You may not use them without our prior written permission, except to refer factually to the Service.
10. Third-party content and templates
The Service displays implant templates, blade profiles, and similar manufacturer-provided artefacts to support surgical planning. These remain the intellectual property of the respective manufacturers. We display them under licence or as fair-dealing reference material for the planning purposes of qualified veterinary users. You may not extract, reproduce, or redistribute these artefacts outside the Service.
11. Privacy
Our handling of your personal information is described in our Privacy Policy at librevet.com/privacy. By using the Service you acknowledge that you have read and understood the Privacy Policy.
12. Service availability and changes
We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any feature at any time. We will give reasonable notice of significant changes that materially reduce functionality.
We may update the Service automatically. Updates may add, modify, or remove features.
13. Termination
You may stop using the Service and delete your account at any time. Deleting your account triggers the data deletion process described in our Privacy Policy.
We may suspend or terminate your access if you breach these Terms, if your use creates risk or possible liability for us or other users, or if we are required to do so by law. Where possible, we will give you notice and an opportunity to address the issue first. Sections that by their nature should survive termination (including sections 5, 6, 7, 9, 14, 15, 16, 17, and 18) survive.
14. Warranty disclaimer
The Service is provided “as is” and “as available” without warranty of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that measurements, overlays, or other outputs will be accurate or suitable for any clinical purpose.
To the extent that any consumer-protection or other mandatory law applies and cannot be excluded, our liability under that law is limited to the maximum extent permitted.
15. Limitation of liability
To the maximum extent permitted by law, in no event will Kakariki, its directors, employees, contractors, or service providers be liable to you or any third party for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost data, business interruption, loss of clinical outcomes, or surgical complications, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or related to these Terms or the Service will not exceed NZD $100 or the amount you have paid us in the 12 months preceding the event giving rise to the claim, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.
16. Indemnification
You agree to indemnify and hold harmless Kakariki, its directors, employees, contractors, and service providers from any claim, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of (a) your use of the Service, (b) Your Content, (c) your breach of these Terms, or (d) your violation of any law or the rights of any third party.
17. Governing law and disputes
These Terms are governed by the laws of New Zealand, without regard to its conflict-of-laws principles. You and Kakariki submit to the exclusive jurisdiction of the courts of New Zealand for any dispute arising out of or related to these Terms or the Service, except that we may seek injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information.
If you reside in the European Union, the United Kingdom, or another jurisdiction whose laws grant you a non-waivable right to sue in your local courts or to apply your local consumer-protection laws, those rights are not affected by this section.
18. General
Entire agreement. These Terms and the Privacy Policy together constitute the entire agreement between you and Kakariki regarding the Service and supersede any prior agreement.
Severability. If any provision is held to be unenforceable, the remaining provisions remain in full force.
No waiver. Our failure to enforce any right or provision will not be a waiver of that right.
Assignment. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Changes to these Terms. We may update these Terms from time to time. Material changes will be notified by email and reflected on this page with an updated effective date. Continued use of the Service after the effective date of the updated Terms constitutes acceptance.
